Frequently asked questions

Disciplinary Tribunal processes

On this page you'll find answers to some commonly asked questions.

Who will be at an in person hearing?

Attendees of a hearing include:

  • the panel, made up of the Chair or Deputy Chair who will lead the proceedings, two registered and experienced teachers.

  • Disciplinary Tribunal Coordinator who is responsible for ensuring the hearing runs smoothly, swears in any witnesses and supports the panel. The DT coordinator is not a decision maker.

  • A lawyer who will be representing the CAC plus any witnesses they will be calling for their case.

  • Media and members of the public are able to attend unless otherwise directed by the Tribunal Chair

How do I apply for name suppression?

To apply for name suppression a statement explaining why non-publication orders should be made plus any supporting documentation should be sent through to counsel for the CAC and the DT Coordinator in advance of the hearing.

The Panel will consider the application along with the CAC’s position then make a decision.

What is a Pre-Hearing Conference (PHC)?

A PHC is a short online meeting between the Tribunal Chair, counsel for the CAC and the teacher and/or teacher’s counsel. The DT coordinator will also attend. The purpose of the meeting is to determine the timeframe for when submissions are due to be filed and to set the date and mode of the hearing.

What does a hearing ‘on the papers’ mean?

This is where the Disciplinary Tribunal will review and make a decision on a case based on written submissions from both parties where it’s convenient, practical and fair to do so.
